 Healthcare providers including  hospitals, physicians, home health agencies, nursing homes and other covered  entities operating a healthcare program are required to comply with the  anti-discrimination requirements in Section 1557 of the Affordable Care Act.  This law is the first to prohibit discrimination based on sex, which includes  gender and gender identity. Hospitals will need to write a policy, train their  staff, revise their patient rights statement, post new signs, have qualified  interpreters and assign someone to handle nondiscrimination complaints. CMS is  also proposing changes to the Conditions of Participation to align with Section  1557 making it imperative to update your policies now to ensure compliance and  avoid legal trouble and penalties.

 Sue  is the past Director of Hospital Patient Safety with The Doctors Company and  OHIC Insurance Company. She is on the board for the Emergency Medicine Patient  Safety Foundation and previously was their chief learning officer.She  has past experience as a nursing professor, medical malpractice defense  attorney, and director of health policy and risk management for eight years for  the Ohio Hospital Association.Sue  is also past VP of legal services, compliance officer and privacy officer for a  community hospital.
